ABOUT
Edwin Wheeler is an accomplished attorney with over twenty years of experience in all aspects of intellectual property litigation. Edwin previously worked as a partner in the IP litigation practices at Howrey and McDermott Will & Emery. He has represented Fortune 500 companies in dozens of patent cases in District Courts, the Federal Circuit, and the ITC. Edwin has served as lead counsel or co-lead counsel in jury trials, bench trials, administrative hearings, and arbitrations in patent, trademark/trade dress, trade secret, and antitrust litigations. He has also managed patent litigations in courts throughout Europe and attended multiple trials in Germany (all jurisdictions), the UK, the Netherlands, and the EPO. Edwin is an experienced negotiator who has participated in and documented numerous complex IP licensing arrangements. Career Highlights:
- Successfully represented a major Chinese LED manufacturer as lead counsel in two Section 337 ITC investigations. Secured dismissal of the first investigation before trial and won a decision of no violation following trial in the second case.
- Won a $66 million jury verdict for a leading U.S. LED manufacturer following a Chinese competitor’s misappropriation of trade secrets critical to the manufacture of high-power LED lighting chips.
- As Vice President, Patent Litigation for Rovi Corporation, managed patent disputes at the ITC, in multiple District Courts, in the courts of every major country in Europe, and at the EPO, supporting Rovi’s patent licensing business which generated annual revenue of several hundred million dollars.
- Won a patent jury trial in Delaware enforcing patents covering key aspects of V.34, V.90, and V.92 analog modem standards, securing an award of $7.6 million.
- Successfully represented a major medical device company in a case alleging infringement of six patents by the client’s most advanced ultrasound medical imaging machines. Case settled favorably shortly before expert depositions and Markman hearing.
- Successfully represented a major medical device manufacturer in an arbitration brought by a terminated technology development partner for trade secret misappropriation, breach of contract, fraud, and antitrust violations.
- Won a preliminary injunction in a trade dress infringement case for the leading U.S. manufacturer of handheld digital multimeters, resulting in a series of competitors settling favorably with my client and enhancing the client’s trade dress marketing strategy.
- Successfully represented the California Department of Health Services in a patent infringement case regarding a widely-used maternal blood test for Down’s Syndrome.
